In CA, people can be separated before they ever file paperwork or meet with an attorney. The “Date of Separation” is defined as the date that one person no longer desires to resume the marriage and communicates or takes some action in furtherance of that desire to end the marriage. Analysis of each spouses’ living situation and personal conduct is extremely important in determining where “separation” has actually occurred. Legal separation can have very serious impacts on the financial aspects of any case. As of the Date of Separation one spouse can start building a “tab” of money that can be legally reimbursable to the other spouse in the divorce, often times without ever knowing it. This is one of the most important reasons anyone contemplating a divorce or legal separation should consult with an experienced family law attorney…you could already be considered legally separated and you should know your rights and obligations at the soonest possible date.
